Orders placed on this site imply the Customer's unconditional acceptance of the following General Terms and Conditions of Sale of Durabilis s.r.l. .
Please note that the Conditions described are in accordance with Italian DL 206/2005 "Codice del Consumo".
1) Modalities of access
To access the private area of the site and to place orders through the online catalog, all users must have properly registered.
2) Prices
Prices listed in the Catalog are valid at the time of purchase and binding for the individual order.
Prices may change without notice. Any decreases, even temporary, in prices will not result in adjustment of the price paid or cancellation of the purchase order by the customer.
Amounts are inclusive of VAT.
3) Methods for placing the order. Acceptance of the general conditions of sale
The customer has the right to order goods directly from the site by making use of the specially prepared e-shop. Failure to accept these conditions of sale precludes the possibility of purchasing on the site.
The order will be finalized only after selecting the payment method and having confirmation of acceptance of the order by Durabilis s.r.l.
The customer is entitled to print and save these terms and conditions.
4) Payment methods and billing
The following payment methods are valid:
- credit card, prepaid card, The order is processed immediately
- bank wire transfer in advance. Details are given in the email that will be sent after the customer confirms the order. The order will enter processing immediately after verification of the credit. In case of a transfer of less than the due amount, the goods will be sent only after receiving the missing supplementary amount.
Proof of purchase, valid for both tax and warranty purposes, is the order confirmation sent by email.
5) Billing
Qualified companies and professionals can request the issuance of electronic invoice. For this purpose they must promptly notify as soon as they receive the confirmation with the order number this option by email. The data for the invoice can be entered upon registration or by completing the master data sheet in one's profile. Failing that, they can be communicated by email upon request.
6) Order fulfillment
In addition to what is described at point "4) Payment Methods", if the goods are fully available, the order will enter processing on the first next business day. If several days are required for the receipt of the missing item from suppliers, the order will be processed only after the arrival of the missing products. Partial shipments will not be made.
If items are unavailable, out of stock, no longer distributed by suppliers, Durabilis s.r.l. will notify the customer and propose alternative products. If the customer accepts the substitution, the order will be modified and any price difference will be settled as agreed.
If the customer waives the replacement, Durabilis s.r.l. will refund the difference.
7) Delivery and acceptance of goods. Non-collection and storage
The goods are sent by our trusted courier with insured and trackable shipping.
Delivery time varies depending on the destination. Shipment will be notified by e-mail.
Transportation costs are, unless otherwise specified, the responsibility of the seller.
In case of non-collection, the package will enter into storage at the courier, and after the third day, it will be returned to Durabilis s.r.l., which will settle the charges to the courier, assess the status of the goods, and return to the customer the amount paid net of the aforementioned charges and a penalty of 25% on the residual with a maximum of Euro 50.00 (Euro fifty/00) as reimbursement of expenses for handling the file.
The customer is required to check the condition of the packages and verify their integrity. If he/she verifies signs of break-in or obvious damage, he/she must make the claim before collection.
If, upon opening the package, you find accidental damage, you must promptly inform Durabilis s.r.l. by email addressed to: info@theluxbags.com, indicating the details of the order, briefly describing the damage found and attaching a photo of the package with the damaged products and the product in question, so as to clearly highlight the damage suffered. Durabilis s.r.l. will contact the customer to resolve the case. Complaints reported late will not be accepted.
8) Responsibilities
Durabilis s.r.l. can in no case be considered responsible for the consequences resulting from the total or partial fulfillment or cancellation of orders placed by the Customer.
Durabilis s.r.l. cannot under any circumstances be considered liable for damages to persons, animals or property caused by the improper use of the purchased goods by the customer.
Therefore, the customer is obliged to scrupulously observe what is stated on the packaging, in the package inserts having special regard to the safety and storage regulations of the product.
For processed orders, Durabilis s.r.l.'s liability ceases when the goods are delivered to the carrier or Post Office.
It is the Customer's responsibility to pick up the goods as soon as possible. The Customer assumes all responsibility in connection with delivery instructions that are incorrect, insufficient or not complied with by him. In case of theft, loss, damage of the goods due to ascertained default on the part of the Customer, the Customer shall assume full responsibility.
9) Warranty
Products are warranted by their respective manufacturers or distributors according to the warranty terms practiced by them.
The warranty is valid as long as the products have been stored properly.
For equipment, accessories and items in general, warranty is not recognized against misuse, inexperience, dropping or accidental impact. More precise specifications regarding warranty conditions for particular products and equipment are usually attached to the product. Said conditions supplement or supersede this article.
10) Right of withdrawal
The Right of Withdrawal is subject to DL 206/2005 "Codica del Consumo" and can be exercised by the Customer by proceeding as indicated on this page.
11) Delivery error. Damaged goods
If there is a mishap, either total (wrong package) or partial (one or more wrong items in the package) in the delivery, or if one or more items are broken due to bumps in transportation, the Customer must immediately notify Durabilis s.r.l.
Customer will have to take these actions:
- Avvertire Durabilis s.r.l. , a mezzo email all’indirizzo info@theluxbags.com, indicando:
(a) Tax Receipt references (number and date).
(b) The code of the missing or broken items reported in the Tax Receipt and the quantity thereof.
(c) in the case of broken items, attach photos demonstrating the damage, taking care to photograph the packaging as well - Wait for communication from Durabilis s.r.l. on the handling of the claim
In the event of a delivery error (wrong item), Durabilis s.r.l. will either replace the items or refund the equivalent value by issuing an equivalent voucher.
In the event of accidental breakage of one or more items, and if Durabilis s.r.l. recognizes that the damage resulted from an accidental event, Durabilis s.r.l. will send the broken items or refund their equivalent value by issuing a voucher or purchase in an equivalent amount.
Durabilis s.r.l. does not accept claims after 24 hours of receipt of parcels.
12) Final notes
The contract of sale is concluded in Italy and governed by Italian law.
For the purpose of the fulfillment of the contract of sale and purchase, the Customer with the purchase from this site:
- implicitly accepts the provisions of Legislative Decree No. 196/2003 ("Personal Data Protection Code") and the amendments introduced by the European Union Regulation No. 679/2016, also known as "GDPR" and subsequent amendments, and declares to have read them
- accepts these terms and conditions
The European resident Consumer is informed that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by the European Consumer to non-judicially resolve any dispute relating to and/or arising from contracts for the sale of goods and services concluded online.
Accordingly, if you are a Consumer established in Europe, you may use this platform for the resolution of any dispute arising from the online contract entered into on this site.
